Memory Notes
Terms of Use
Last updated: October 19, 2026
These terms are an agreement between you and EmoDino LLC (“we”, “us”) for using the Memory Notes app, its servers and its MCP server (together, “Memory Notes”). By using Memory Notes you agree to them.
If you got the app from the App Store, your license to use it is Apple’s Licensed Application End User License Agreement (the “Apple EULA”). These terms add to it, covering our servers, your account and your subscription. If the two conflict about the license to the app, the Apple EULA wins.
Your account
You can use Memory Notes without an account. If you sign in, keep access to your email secure; you’re responsible for what happens under your account, including what the AI assistants you connect do with the access you give them. You must be at least 13 to use Memory Notes.
Your content
Your memories and recordings belong to you. You give us permission to store, process and transmit them only as needed to run Memory Notes for you, as described in the privacy policy. You can delete them at any time.
Ask and AI answers
Ask uses AI models to answer questions from your memories. Answers can be incomplete or wrong, even though they cite the memories they used. Check anything important against the memory itself, and don’t rely on Ask for medical, legal, financial or safety decisions. Each question counts as a search toward your plan’s limit.
Subscriptions
Plans
Memory Notes has two monthly plans. Prices are in US dollars; the App Store shows the price in your currency before you buy.
| Plan | Price | Each month |
|---|---|---|
| Regular | $1.99 a month | Up to 200 notes and 150 searches |
| Heavy | $4.99 a month | Up to 1,000 notes and 300 searches |
A note is any memory you create: by voice, by typing, or through a connected AI assistant or the API. A search is a question you ask in the app, or a search or question from a connected assistant. Editing or deleting a note doesn’t count, and deleting one doesn’t give it back. Limits reset on the 1st of each month at midnight UTC. Unused notes and searches don’t carry over.
Free trial
The first 7 days are free, starting when you first open the app (or create your account, if that came first). The trial includes 200 notes and 150 searches. It’s our own trial, not an App Store free trial: you don’t give a payment method, and nothing is charged when it ends.
When the trial ends, or a subscription ends, Memory Notes becomes read-only. You can still open, read, play, edit and delete your notes, but you can’t add new ones or search until you subscribe. Your notes are not deleted.
Payment and auto-renewal
- Payment is charged to your Apple Account when you confirm the purchase. Apple processes all payments; we never see your card.
- Your subscription renews automatically every month at the same price unless you cancel it at least 24 hours before the end of the current period. Your Apple Account is charged for the renewal within the 24 hours before the period ends.
- To cancel, go to Settings on your iPhone or iPad, tap your name, then Subscriptions, or use Account → Plan → Manage subscription in the app. See Apple’s guide to cancelling a subscription. Cancelling stops the next renewal; you keep your plan until the end of the period you’ve paid for. Deleting the app or your account doesn’t cancel a subscription.
- If a renewal payment fails, you keep your plan for up to 3 days while Apple retries. If it still fails, the subscription ends.
- Switching from Regular to Heavy takes effect right away, and Apple credits the unused part of your Regular month. Switching from Heavy to Regular takes effect at your next renewal.
- Bought on another device, or reinstalled the app? Use Restore Purchases in the app (on the plans screen, or Account → Plan).
Refunds
We don’t give refunds or credits for partial months, or for notes and searches you didn’t use, except where the law requires it. Because Apple handles payment, refunds are decided by Apple: request one at reportaproblem.apple.com.
Price changes
We may change the price of a plan. Apple tells you before a new price applies to your subscription and, where Apple or the law requires it, asks you to agree first. If you don’t want to pay the new price, cancel before it takes effect.
Fair use limits
Your plan’s note and search limits are the limits you pay for. On top of them we apply a few technical limits, such as a daily cap on searches and on how many notes one account can sync, to protect the service from abuse and runaway scripts. Normal use, in the app or through an assistant, doesn’t come close to them. If we lower the limits of your plan, the change applies from your next renewal, and we’ll tell you in the app first.
Connected AI assistants
If you connect a third-party AI assistant, that service is governed by its own terms and privacy policy, and we’re not responsible for what it does with your memories. Give write access only to assistants you trust, and revoke access you no longer need.
Fair use
Don’t misuse Memory Notes. In particular, don’t:
- try to access another person’s account or data;
- probe, overload or disrupt our servers, or get around usage limits or the free trial (for example, by making accounts to restart it);
- use Memory Notes to break the law or to store unlawful content;
- resell or reverse engineer the service.
We may suspend or close accounts that break these rules, and will tell you why unless the law or safety prevents it.
Changes and availability
We’re a small team and Memory Notes will change over time. We may add, change or remove features. If we ever shut down the service, we will give you notice and a way to export your memories first.
No warranty
Memory Notes is provided “as is” and “as available”, without warranties of any kind, to the extent the law allows. We work to keep your data safe and the service running, but we can’t promise it will be uninterrupted or error-free. Keep your own copy of anything you can’t afford to lose.
Limitation of liability
To the extent the law allows, EmoDino LLC isn’t liable for indirect, incidental or consequential damages, or for lost data or profits, arising from your use of Memory Notes. Our total liability for any claim is limited to the greater of the amount you paid us in the past 12 months or US$50. Some places don’t allow these limits, so they may not apply to you.
Governing law
These terms are governed by the laws of the State of New York, USA, without regard to its conflict-of-law rules.
Changes to these terms
If we change these terms, we’ll update the date above, and tell you in the app if the change is significant. Continuing to use Memory Notes after a change means you accept the new terms.
